About these terms
These terms apply to the Herald app for iPhone, iPad, Apple Watch and Android and to this website. Herald is developed and published by lukethedev (“we”, “us”). By buying, downloading or using Herald, you agree to these terms. If you don’t agree, please don’t use it.
If you got Herald from the App Store, Apple’s Licensed Application End User License Agreement also applies. If you got it from Google Play, the Google Play Terms of Service apply as well. Where they conflict with these terms, the store’s terms win for matters they cover.
An independent app
Herald is not an official Hermes Agent app. It is not affiliated with, made, endorsed or supported by Nous Research. Hermes Agent and other third-party names, logos and services belong to their owners.
Price, purchase and refunds
Herald costs $12.99 USD as a one-time purchase. The App Store and Google Play set the price in your local currency, including any taxes. There are no subscriptions and no in-app purchases. We may change the price for future buyers, but that never affects a purchase you have already made.
A purchase on the App Store covers Herald on your iPhone, iPad and Apple Watch under your Apple Account. A purchase on Google Play covers Herald on your Android devices under your Google account. The two stores are separate, so buying on one does not unlock the other. You can download Herald again on the same store account at no extra cost.
Payments and refunds are handled by the store you bought from. To ask for a refund, use reportaproblem.apple.com for the App Store, or follow Google Play’s refund process. If something isn’t working, contact us first. We are glad to help.
Your licence
We grant you a personal, non-exclusive, non-transferable licence to use Herald on devices you own or control, as allowed by the store you bought it from. You may not resell, rent or redistribute the app, or remove its notices.
Herald, its design and this website are our property, apart from open-source components, fonts and artwork, which keep their own licences.
Your Hermes setup
Herald is a client for a Hermes Agent instance that you run. You are responsible for that computer or server, its network access, the model providers you use and any costs they charge. Herald does not include a hosted AI model or guarantee any provider’s availability.
Only connect to Hermes instances you are allowed to use. Keep your software up to date, protect your passwords and pairing codes, and set up network access securely. Remote features work only while your computer is on and reachable.
Some features depend on your device, operating system version, Hermes version, plugins and settings. Some features, such as Live Activities, widgets, Siri, Apple Watch and CarPlay, are available only on Apple devices.
When driving, only use Herald through CarPlay’s voice interface and only when it is safe and legal to do so. Never let a conversation with your agents distract you from the road.
Responsible use
Use Herald lawfully. Don’t use it to harm others, break into systems, spread malware, harass people or infringe privacy or intellectual property rights.
You are responsible for what you send, the tools and permissions you give your agents, and the actions you approve. Read approval requests carefully before you allow anything that could change files, send messages, spend money or affect someone else.
AI output and actions
AI output can be wrong, incomplete or out of date. Check important information and review code, files and proposed actions before you rely on them. AI output is not professional medical, legal or financial advice. Your Hermes, its tools and its providers do the work. Herald can’t guarantee that a response is accurate, that an agent’s actions are safe, or that every action will ask for approval first. Keep backups and set permissions to suit how you work.
Third-party services
Hermes Agent, model providers, Tailscale, Expo, Apple, Google, HermesMailAgent and other services you connect are run by others. Their terms, prices, limits and privacy policies apply when you use them. Links to other sites are provided for convenience and are not an endorsement.
The website and demo
The phone on this website is an interactive illustration. Its bots, messages and approvals are samples with scripted replies. Nothing is sent to an AI model or a Hermes instance. The real app may look and behave differently.
Updates and availability
We work to keep Herald compatible with current versions of iOS, Android and Hermes Agent, and we may add, change or remove features over time. We can’t guarantee that Herald will work with every version, setup or device, or that it will always be available.
Consumer rights and liability
Nothing in these terms excludes, restricts or changes any rights you have under consumer law that can’t be excluded, including the consumer guarantees under the Australian Consumer Law. If those guarantees apply and Herald fails to meet them, you may be entitled to a repair, replacement or refund. See the ACCC’s guide to consumer guarantees.
To the extent the law allows, Herald is provided “as is”, and we are not liable for indirect or consequential loss, or for loss caused by your Hermes, its tools or providers, or actions you approve. Where our liability can be limited but not excluded, it is limited to the amount you paid for Herald or, for services, supplying them again.
Additional terms for Apple devices
If you use Herald on an Apple device, you also agree that:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Herald and its content.
- Apple has no obligation to provide maintenance or support for Herald.
- If Herald fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the extent the law allows, Apple has no other warranty obligation for Herald.
- We, not Apple, are responsible for handling any claims relating to Herald, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
- You are not located in a country subject to a U.S. government embargo, and you are not on a U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
General
You can stop using Herald at any time. We may suspend support for someone who misuses it. If part of these terms can’t be enforced, the rest still applies. These terms are governed by the laws of Australia, and nothing here limits a complaint you can make to a consumer or privacy regulator where you live.
We may update these terms. When we do, we will change the date at the top, and we will give notice of material changes where required. Changes never take away rights you have already gained.
